Applicable Statutes

S.D. Codified Laws § 21-16-2

Forcible entry and detainer: landlord must give written notice before filing eviction. For nonpayment of rent, a 3-day notice to pay or vacate is required.

S.D. Codified Laws § 43-32-16

Termination of periodic tenancy: for month-to-month tenancies, notice must be given equal to the rental period (minimum 30 days).
