Applicable Statutes
Notice to terminate tenancy: for a month-to-month tenancy, either party must give at least one month's written notice before the end of a rental period.
Ind. Code § 32-31-1-8
Termination for nonpayment of rent: landlord may terminate the tenancy if the tenant fails to pay rent when due, after proper demand.
Ind. Code § 32-30-2-4
Eviction proceedings: landlord may file for eviction in small claims court (county or township) after tenancy is properly terminated.
